Terms of Service

1. Acceptance

By creating an account or using Whirely ("Service"), you agree to these Terms. If you do not agree, do not use the Service.

2. Service Description

Whirely is an AI-assisted electronics design tool. It generates circuit diagrams, firmware code, parts lists, and assembly guides based on user-provided descriptions. Output is intended as a starting point and may contain errors.

3. User Responsibilities

• You are responsible for verifying circuit designs before building or powering them.
• You must not use the Service for any illegal purpose or to design devices intended to cause harm.
• You must be at least 13 years old to use the Service.
• You are responsible for maintaining the security of your account credentials.

4. AI-Generated Content

Designs are generated by AI and are not guaranteed to be accurate, safe, or fit for any specific purpose. Always review designs with a qualified engineer before use in safety-critical applications. Whirely is not liable for damages resulting from errors in generated output.

5. Subscriptions and Billing

• Free accounts receive 3 designs per month at no cost.
• Pro accounts are billed monthly via PayPal. You may cancel at any time from your PayPal account.
• Cancellations take effect at the end of the current billing period. No partial refunds are issued.
• We reserve the right to change pricing with 30 days' notice.

6. Intellectual Property

You retain ownership of the designs you generate. By using the Service you grant Whirely a limited license to process your prompts to deliver results. We do not sell your designs.

7. Limitation of Liability

To the fullest extent permitted by law, Whirely's total liability for any claim arising from use of the Service is limited to the amount you paid in the 12 months prior to the claim, or $10, whichever is greater.

8. Termination

We may suspend or terminate accounts that violate these Terms. You may delete your account at any time by contacting hello@whirely.com.

9. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated via email.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles.
